Americhek respects your privacy and is committed to ensuring the confidentiality of your personal information. Americhek uses safe and secure systems, physical and electronic, to safeguard information about you. The statement below explains how we may collect, use, and safeguard your personal data information.
The Information We Collect About You
Americhek’s privacy policy applies to all information we receive from you, or from our clients about you in connection with a request for a background check, whether that information is submitted via fax, electronically, or online. We only collect online information from you or about you when 1) you are filling out an online employment application that will be transmitted to Americhek via electronic means or 2) when our clients use our secured website to order background checks, or 3) when you or our clients use other means to transmit information about you to us. In these situations we collect certain information from and/or about you to process the background check request.
Information Collected from You or Our Clients:
Information we collect from you and/or our clients may include but is not limited to the following:
- First and last name (middle initial and suffix, as applicable);
- Social Security number
- Date and year of birth
- Home telephone number
- Current home address
- Email address
- Previous counties and states you have lived in
- Driver’s license number, state of issue, name, and address on license
- Your Employment History
- Your Education History
- Personal or Professional Reference
How We Use Information, Information from Others, What We Collect & to Whom We May Disclose the Information We Collect
Americhek uses the information collected to process requests for background checks. Information we collect is used only to perform the necessary functions of processing the background check. To perform and process a background check, it is often necessary to share this information with third parties such as employers, schools, governmental agencies, credit bureaus, courthouses, and others as permitted by law. We may also collect information about you from our clients who order the background checks.
We do not disclose (sell, rent or provide) the personally identifiable information or any other information you provide to us to any third party for any marketing purposes whatsoever. Information that we collect to perform the background check may be disclosed to our selected third parties as necessary to perform the background check, or consumer credit reporting agencies as required to investigate credit disputes.
Opting Out of Our Providing Information about You To Third Parties
If you prefer that we not disclose to non-affiliated third parties any personal information that we collect from you in connection with the background check you may choose to opt out. That is, you may direct us not to make these disclosures. However, if you choose to opt out, Americhek cannot proceed with the background check investigation. By completing and the Background Check Release Form you are giving permission for Americhek to contact third parties and provide them with information about you. Third parties might include employers and schools, and should you opt out, we cannot verify your employment history, your education, or complete other searches requested by our client. If you choose to opt out, do not complete or sign the Background Check Release Form.
Personal Information Disclosure: United States or Overseas:
Americhek will not share your information with any third party outside of our organization, except as necessary to gather the information needed to produce the requested consumer report or as required by law under a court order.
At times, Americhek , in the course of doing a background check on you, may send your personal information to schools, employers, or court agencies located overseas. When Americhek conducts an international background check for verification of employment, education, or for a criminal record check, we may need to provide certain personal information about you to these schools, employers, or courts located overseas.

California Civil Code Section 1786.20:
Americhek shall maintain reasonable procedures designed to avoid violations of California Civil Code Section 1786.18 and to limit furnishing of investigative consumer reports for the purposes listed under Section 1786.12. These procedures shall require that prospective users (our clients)of the information identify themselves, certify the purposes for which the information is sought and that the information will be used for no other purposes, and make the certifications described in paragraph (4) of subdivision (a) of Section 1786.16.
Americhek shall keep a record of the purposes for which information is sought, as stated by the user. Americhek shall inform the user that the user is obligated to notify the agency of any change in the purpose for which information will be used. Americhek shall make a reasonable effort to verify the identity of a new prospective user (client) and the uses certified by the prospective user prior to furnishing the user any investigative consumer reports. An investigative consumer reporting agency may not furnish an investigative consumer report to a person unless it has a written agreement that the investigative consumer reports will be used by that person only for purposes listed in Section 1786.12 of the California Civil Code.
(b) Whenever Americhek prepares an investigative consumer report, it shall follow reasonable procedures to assure maximum possible accuracy of the information concerning the individual about whom the report relates. Americhek shall retain the investigative consumer report for two years after the report is provided.
(c) Americhek will not make an inquiry for the purpose of preparing an investigative consumer report on a consumer for employment purposes if the making of the inquiry by an employer or prospective employer of the consumer would violate applicable federal or state equal employment opportunity law or regulation.
Security and Confidentiality
Americhek is committed to providing secure safeguards and the privacy of the information you provide us through online forms, online ordering via our website, or via the electronic or faxing of your personal information. For background checks submitted to us online or via electronic means, we use programs that encrypt the information you or our clients provide prior to its transmission to Americhek Information you or our clients provide us online is transmitted to us through a secured socket layer (SSL) transmission. Many areas of our website require a User ID and password as an added security measure to help protect confidential information.
Further, we have security protocols and measures in place which include internal and external firewalls, physical security and technological security measures, and encryption of certain information to ensure against unauthorized access or alteration of data.
Accountability
We take reasonable precautions to be sure that unaffiliated third parties or affiliates, to whom information is disclosed, as described above, treat the personally identifiable information in a similarly responsible manner to our privacy policy.
